This website is owned and operated by Kuon Lix LLC from the United States. Throughout the Site, the terms “we”, “us”, “Kuon Lix” and “our” refer to Kuon Lix LLC. We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms and Conditions apply to all users of the site, including without limitation users who are browsers, customers, merchants, and/ or contributors of content.

By accessing or using our Services, you agree to these Terms, conditions, and all applicable laws. If you do not agree with these Terms, our Privacy Policy, or any other of our policy, you should not use the Services.

1. General Information – Kuon Lix

• Sole discretion. We reserve the right to add/discontinue any product or service anytime at the sole discretion and without notice.

1. Eligibility

The purchase of products through Kuon Lix is strictly limited to parties who can lawfully enter into and form contracts on the Internet.  If you are under age 18, you may only use the Services with the consent of your parent or legal guardian. Please be sure your parent or legal guardian has reviewed and discussed these Terms with you.

By making an offer to purchase products you expressly authorize us to perform credit checks and where Kuon Lix feels necessary, to transmit or to obtain information (including any updated information) about you to or from third parties, including but not limited to your credit/debit card number or credit reports (including credit reports for your spouse if you reside in a community property jurisdiction), to authenticate your identity, to validate your credit/debit card, to obtain an initial credit/debit card authorization and to authorize individual purchase transactions.

Kuon Lix reserves the right to restrict multiple quantities of an item being shipped to any one customer or postal address.

1. Pricing Policy

Prices shown on the Site are in US Dollars and are exclusive of taxes.  Sales tax will only be charged on orders where applicable.

Sometimes we need to make changes to the price of some of our products. When this happens, we’ll update the prices on our website. If you had placed your order for a product before the price change, the price will be as stated on our website at the time when you had placed your order.

1. Registration and Monthly Subscriptions

In order to start your ongoing Kuon Lix monthly subscription, you must register as a member on our Site. To register, you must provide information about your dog (including its name and size), your selected subscription plan and shipping information including your address and billing information, and your valid email address and password to create your login profile. All information that you provide to Kuon Lix, including your credit card information, is subject to Kuon Lix’s Privacy Policy. You are responsible for keeping your registration information up to date through the member account management area on the Site. As a registered user of Kuon Lix, you agree to receive emails promoting any special offer(s), including third party offers. We may from time to time send you our newsletter and similar communications. You may opt-out from receiving special promotions or our newsletter by opting to unsubscribe as may be provided in the applicable e-mail correspondence. You cannot opt-out of certain e-mails regarding transactions you enter into with us.

1. Meal Delivery

As a subscribed Kuon Lix member, at the intervals specified in your selected subscription plan, we will ship you a package with the meals specified in your selected subscription plan (“Products”). BY SUBSCRIBING YOU AGREE TO PAY THE SUBSCRIPTION FEE APPLICABLE TO YOUR SUBSCRIPTION PLAN.

1. Billings
   1. The price of the Services and/or Products is payable in full before delivery. When you first sign up for a subscription to a Kuon Lix subscription plan (a “Plan”), you are charged only for the first delivery of the Plan at the time of your Plan selection. All Plans are continuous AUTORENEWING subscription plans, and you will be charged the applicable price listed for the Plan that you select on a weekly, biweekly (every two week), or monthly basis, based on your plan until your subscription is cancelled. If you wish to pause, cancel or modify your subscription to a Plan, you can do so at any time; however, except as noted otherwise below, any amounts charged to or paid by you prior to such pause or cancellation will not be refunded, and pauses or cancellations may not impact any order for which you have already been charged, depending on the state of the order.. You authorize us to continue billing the credit card on file weekly during the term of your subscription plan until and unless the subscription plan ends or is paused or cancelled in accordance with the foregoing guidelines and policies. It is your responsibility to keep your payment method up-to-date, as well as to cancel your membership as described in the password-protected member account management area should you wish to discontinue your weekly purchase of Products.
   2. Payment processing for the Services is provided by Stripe, Inc. or such other third party payment processor as we may utilize from time to time (“Payment Processor”). Kuon Lix does not collect or store your credit card information. You can find out more about both our privacy practices and our Payment Processor’s privacy practice in our Privacy Policy and the links therein. By providing a credit card or other payment method accepted by Kuon Lix, you represent and warrant that you are authorized to use the designated payment method and that you authorize our Payment Processor to charge your payment method for the total amount of your transaction and any applicable fees (including any applicable taxes and other charges). If the payment method you provide cannot be verified, is invalid or is otherwise not acceptable, your account may be suspended or cancelled. You must resolve any problem we or our Payment Processor encounters in order to proceed with your use of your account.
   3. Following your plan selection and placement and receipt of your first weekly order, you may pause or cancel a subscription to a plan at any time online by managing your account at on the site, or by emailing us at support@kuonlix.com. Please note, however, that any amounts charged to or paid by you prior to such pause or cancellation will not be refunded, and a pause or cancellation may not impact any active order for which you have already been charged, depending on the status of the order.

TO AVOID BEING CHARGED FOR PLACED ORDERS THAT YOU NO LONGER WISH TO RECEIVE IN THE EVENT OF A SUBSCRIPTION PAUSE, YOU MUST PAUSE PRIOR TO THE DATE WHEN YOU ARE TO BE CHARGED FOR YOUR NEXT ORDER, WHICH IS EMAILED TO YOU AT LEAST 24 HOURS PRIOR TO THE CARD BEING CHARGED. THE CHARGE IS TYPICALLY 4-5 DAYS BEFORE YOUR EXPECTED DELIVERY, DEPENDING ON YOUR SPECIFIED DEADLINE, BUT CAN VARY DEPENDING ON SHIPPING LENGTH AND OTHER FACTORS.

IF YOU CANCEL A SUBSCRIPTION TO A PLAN BEFORE RECEIVING YOUR FIRST ORDER, YOUR FIRST ORDER MAY OR MAY NOT BE CANCELLED AND RELATED AMOUNTS PAID MAY OR MAY NOT BE REFUNDED TO YOU, DEPENDING ON FACTORS INCLUDING THE STATE OF YOUR ORDERS IN OUR PRODUCTION PROCESS, AND ANY PROMOTIONS APPLIED. YOU WILL BE NOTIFIED IF ANY OF YOUR CHARGED ORDERS WILL BE CANCELLED AND REFUNDED, OR IF YOU WILL STILL RECEIVE THE ORDER AFTER CANCELLATION.

1. Shipping/Handling Fees and Taxes

Unless otherwise indicated at the time of your purchase, shipping and handling fees are included with your order. Shipping dates and/or arrival times are only estimates. You must notify Kuon Lix within 30 days of the date of your purchase if you believe all or part of your order is missing or damaged. Replacement of Products and credits to your account for shipped Products claimed as not received are subject to our investigation, which may include postal-service notification. We will adjust your account at our discretion. Repeated claims of undelivered Products may result in the cancellation of your membership. You may be charged, and are solely responsible for, applicable local and state sales tax, if applicable.

1. Returns and Exchanges. 

As the Products are perishable food items, Products may not be returned or exchanged. If you have concerns or problems with the Products you receive, please contact us at support@kuonlix.com and we will attempt to resolve the issue. Kuon Lix shall not issue any refunds for the Products or Services except at its sole discretion

1. Permitted use 

You agree to use the Site and the Services only for purposes that are permitted by these Terms and Conditions and in compliance with all applicable laws, regulations, and generally accepted practices or guidelines in the relevant jurisdictions. You may only use the Site and Services for your non-commercial, non-exclusive, non-assignable, non-transferable, and limited personal use, and no other purposes.

You will not (and will not attempt to):

1. Access any of the Services by any means other than through the interface that is provided by Kuon Lix;
2. Gain unauthorized access to Kuon Lix’s computer system or engage in any activity that interferes with the performance of, or impairs the functionality or security of the Site, the Services, Kuon Lix’s networks, and computer systems;
3. Access any of the Site or the Services through any automated means or with any automated features or devices (including use of scripts or web crawlers);
4. Access or collect any personally identifiable information, including any names, email addresses or other such information for any purpose, including, without limitation, commercial purposes;
5. Reproduce, duplicate, copy, sell, trade, or resell any aspect of the Site or the Services for any purpose; and
6. Reproduce, duplicate, copy, sell, trade or resell any products or services bearing any trademark, service mark, trade name, logo or service mark owned by Kuon Lix in a way that is likely or intended to confuse the owner or authorized user of such marks, names or logos.

1. Discount Codes

We may provide promotional codes offering a discount on our product. Promotional codes cannot be used on past purchases. Promotional codes are non-transferable and there is no cash alternative. Furthermore, they cannot be used in conjunction with any other promotional code or offers and must be used by the date published, if any. Only one promo code can be used at checkout. We reserve the right at any time without notice to retract and/or change the terms of promotional codes.

1. Limited License and Site Access; Acceptable Use

We grant you a limited license to use the Site for personal non-commercial use only. If you use this Site and such use requires setting up an account and/or password(s), you are solely responsible for maintaining the confidentiality of your account and password(s) and for restricting access to your computer.  If you open an account, register, or otherwise provide us with any information, you agree to provide us with current, complete, and accurate information as requested by any forms. Kuon Lix is not responsible for any errors or delays in responding to any inquiry or request caused by any incorrect, outdated, or incorrect information provided by you or any technical problems beyond the control of Kuon Lix. You acknowledge and agree that any login, identifier, or password issued in connection with this Site (each a “Password”) is confidential information and must be kept secure. You may not disclose such a Password to another person or entity or permit another entity to access the Site using such a Password. You must notify Kuon Lix immediately of any breach of security or unauthorised use of your account. 1. Dispute Resolution & Governing Laws

In the event of a dispute arising out of or in connection with these terms or any contract between you and us, then you agree to attempt to settle the dispute by engaging in good faith with us in a process of mediation before commencing arbitration or litigation.

These Terms and Conditions shall be governed by and construed in accordance with the laws of the United States and you hereby submit to the exclusive jurisdiction of the U.S. courts where Kuon Lix is based in.

If you use or engage with the website and are under 18 years of age, you must have your parent’s or legal guardian’s permission to do so.  By using or engaging with the website, you also acknowledge and agree that you are permitted by your jurisdiction’s applicable law to use and/or engage with the website.

1. Assignment

We shall be permitted to assign, transfer, or subcontract our rights and obligations under these terms without your consent or any notice to you. You shall not be permitted to assign, transfer, or subcontract any of your rights and obligations under this agreement.

1. Force Majeure

Kuon Lix is not liable for any delays caused by circumstances beyond Kuon Lix’s control, e.g. general labor dispute, extreme weather, acts of war, fire, lightning, terrorist attacks, changed governmental orders, technical problems, defects in power- /tele-/computer communications or other communication and defects or delays in the service by sub-suppliers due to circumstances set forth above. Such circumstances shall result in relief from damages and other measures. If any such situation should arise, Kuon Lix shall inform the Customer accordingly both at the beginning and the end of the period for the current situation. If the situation has lasted for more than two months, both the Customer and Kuon Lix are entitled to terminate the purchase with immediate effect.

1. Entire Agreement

These Terms and Conditions set forth the entire understanding and agreement between you and Kuon Lix concerning the subject matter herein and supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written concerning the Site. A printed version of these Terms and Conditions and any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms and Conditions to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. Any rights not expressly granted herein are reserved. You may not assign the Terms and Conditions, or assign, transfer or sublicense your rights therein. A failure to act concerning a breach by you or others does not waive Kuon Lix’s right to act concerning subsequent or similar breaches.

1. Term and Termination

This agreement becomes effective the date that you first access the Site and remains effective until it is terminated consistent with its terms. Violations of this agreement may result in the immediate termination of this agreement and denials or terminations of your access to the Site. Such restrictions may be temporary or permanent. Upon termination, your right to use this Site shall be revoked. Upon the revocation of the right to use the Site, you shall destroy, or cause to have destroyed any and all copies of information you have obtained from the Site.
